Draft only — not a signable will

Will draft

This assembles a complete draft will from the shares the calculator computes. Every clause states an explicit fraction for a named person, because an American court will not enforce an instruction to distribute according to Islamic law.

Why every page says draft

No clause here has been reviewed by an attorney, and no state’s execution requirements have been confirmed. The watermark is not a formality: it is set by the absence of a recorded approval, and it will come off only when one exists. Take this draft to a lawyer. Do not sign it as it stands.

Nothing is kept once this tab is gone. Closing or reloading it loses your answers. Save a file to keep them — you can load it back later.

Nothing is stored on our side, so this file is the only copy of your answers. It is ordinary text and contains the names you entered — keep it somewhere private, and note that if you lose it there is no way for us to recover it.

Where you live

You are

Asked because it decides who can survive you as a spouse, and because unpaid mahr is a debt of a husband’s estate but an asset of a wife’s.

Your family

Whether you have a husband or a wife is asked here once you have answered “You are” above.

Grandsons through a son who died before you

A son of a son who did not survive you.

Maternal half-siblings

Same mother, different father. They share equally regardless of sex.

Anyone else who survives you

Some relatives inherit only when certain closer relatives have died. Most will not apply to you — but we have to ask, because if one of them is living and we do not know, the shares will be wrong and nothing will show it.

Other blood relatives

A daughter's or a son's daughter's children, a sister's children, a brother's daughters, a maternal half-brother's children, your mother's father, your mother's brothers and sisters, your father's sisters, your father's maternal half-brother, a daughter of your father's brother, and the children of any of these — which takes in every cousin except a son of your father's full or paternal half-brother. A son of a full brother or of a half-brother by your father, and your father's full or paternal half-brother or his son, are not in this group: they inherit before everyone here, and this form cannot yet record them.

Your children

If you have children, their names go under Sons and Daughters above. This section asks who would care for any under eighteen.

Bequests — the wasiyyah

Each bequest below has a box: “This person is also one of my heirs”. Tick it if that person inherits a share from you in the family you entered above. Leave it unticked for a relative who inherits nothing because a closer relative is alive — for example, a grandchild whose father died before you, while another son of yours is living. That can change: if that other son also died before you, the grandchild could inherit. Check the box again whenever your family changes. By the majority position a bequest to someone who already inherits takes effect only if the other heirs agree to it after your death, and the instructions beside the draft will say so.

Mahr — the marital gift

A question about unpaid mahr appears here once you have answered “You are” above.

Draft not ready: Where do you live?

Where do you live?

Start by telling us where you live and what you are called. The state comes first because it decides how a will has to be signed, who may witness it, and what a surviving spouse can claim whatever your will says.
